The legal process of an MLA resignation involves the speaker of the legislature giving the chief electoral officer a warrant indicating the resignation. After receipt of the warrant, there is a 6 month window of opportunity for cabinet to begin the 28 day writ period.
I have corresponded with Elections BC and confirmed that the warrant was received on the date of resignation, July 15, 2008.
This narrows the latest possible by-election date to February 12, 2009. This has been updated in the Vancouver-Fairview page.
